Welcome to Eleven Vitality. These Terms of Service govern your use of elevenvitality.com (the "Site") and any orders you place with us. By using the Site, creating an account, or placing an order, you agree to these Terms.
If you don't agree, please don't use the Site.
1. Who we are
Eleven Vitality is a U.S. ecommerce company headquartered in Highland Mills, New York. We sell bioidentical hormone creams, vitamin creams, and related kits direct to consumers in the United States. We are not a compounding pharmacy, not a telehealth provider, and not a healthcare provider. Our products are sold over the counter without a prescription.
2. Eligibility
To buy from us, you must be at least 18 years old and have the legal capacity to enter a contract. By placing an order, you confirm you meet both requirements.
3. Your account
You don't need an account to browse, but you need one to check out. You're responsible for keeping your password secure and for any activity under your account. Tell us right away at care@elevenvitality.com if you think someone else used your account.
4. Products and pricing
Product descriptions, photos, ingredient lists, and prices on the Site are for the U.S. market. We try to keep everything accurate, but we don't guarantee that descriptions, photos, or pricing are error-free. If we find a pricing error after you place an order, we'll let you know and either honor the listed price, offer a corrected price you can accept or decline, or cancel the order and refund you.
We reserve the right to limit quantities, refuse an order, or discontinue a product without notice.
5. Orders and payment
When you place an order, you're making an offer to buy. We accept the offer when we send a confirmation email. Until then, we may decline or cancel for any reason, including suspected fraud, sanctioned-region shipping, or stock issues. We charge your payment method when the order ships, unless you used a payment method that authorizes immediately.
We accept the credit cards, digital wallets, and buy-now-pay-later providers shown at checkout. Payment processing is handled by Shopify Payments and the providers you select. We don't store full card numbers on our servers.
6. Shipping
Shipping rules, transit times, and the $79 free-shipping threshold are described in our Shipping Policy. We ship within the United States only. We do not ship to P.O. Boxes or international addresses.
7. Returns and refunds
Returns and refunds are governed by our Refund Policy. Read it before you order.
8. Health information and disclaimer
Everything on the Site is educational. None of it is medical advice. Read our Medical Disclaimer for the full version. Talk to a licensed healthcare provider before starting any new hormone or supplement product, especially if you're pregnant, nursing, trying to conceive, on prescription medication, or managing a chronic condition.
9. Acceptable use
When you use the Site, you agree not to:
- copy, scrape, mirror, or republish our content without written permission
- post reviews you didn't write or that you were paid to write without disclosing it
- attempt to gain unauthorized access to the Site, our systems, or any account
- use the Site to send spam, malware, or anything that interferes with how it runs
- impersonate another person or misrepresent your relationship to anyone
We can suspend or terminate your account if you break these rules.
10. User-submitted content
If you post a review, comment, photo, or any other content on the Site, you grant Eleven Vitality a non-exclusive, worldwide, royalty-free license to use, display, edit, and distribute that content for promotional and operational purposes. You confirm that the content is yours, that it doesn't violate anyone else's rights, and that it's accurate. We may remove anything we believe is misleading, defamatory, or unlawful.
11. Intellectual property
The Eleven Vitality name, logo, product names, formulas, photography, and all original copy on the Site are the property of Eleven Vitality. You can browse, share links, and quote short excerpts with attribution. You can't copy a product description, an article, or a photo onto your own site or marketing without written permission.
12. Third-party links
The Site links to research, articles, and tools hosted by other companies. We don't control those sites and aren't responsible for their content, their privacy practices, or anything you buy from them.
13. Disclaimer of warranties
The Site and our products are provided "as is" and "as available." Within the limits the law allows, we disclaim all warranties, express and implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or secure, or that any specific health outcome will follow from using our products.
Some states don't allow these disclaimers. In those states, the disclaimers apply to the maximum extent the law allows.
14. Limitation of liability
To the fullest extent allowed by law, Eleven Vitality and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising from your use of the Site or our products. Our total liability for any claim related to the Site or your order is limited to the amount you paid for the order in question.
15. Indemnification
You agree to indemnify and hold Eleven Vitality harmless from any claim, loss, or expense (including reasonable attorney's fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that isn't resolved informally goes to the state or federal courts located in Orange County, New York. You and Eleven Vitality each waive the right to a jury trial. Nothing in this section prevents either of us from seeking small-claims relief in the appropriate court.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Site after we publish revised Terms means you accept the new version. If a change is material, we'll notify you by email or by a banner on the Site.
